To Whom It May Concern:
In accordance with 33 U.S.C. §1365(b)(1)(A) of the Clean Water Act (the "CWA") New York State Greens/Green Party of New York, and Citizens' Action Committee for Change, Eva Yaa Asantewaa, Valerie Sheppard, Mitchel Cohen, Robert Lederman intend to bring suit under 33 U.S.C. §1365(a)(1)(A) against the City of New York (the "City") et al. for its violation of the CWA, sections 301(a) of the CWA 33U.S.C.§1365 and §7002 (a)(1)(A) and (B) of the Resource Conservation Recovery Act ("RCRA"), 42 U.S.C. § 6972 (a)(1)(A) AND
(B). For several weeks, the City has discharged toxic pesticides from its Malathion spraying program into the East River, Jamaica Bay, Hudson River and other waterways, tributaries and water bodies located within the boundaries of New York City. The discharge of Malathion, synthetic pyrethroids, and other pesticides began as early as September 2, 1999 and continues today.
The un-permitted discharge of toxic pesticides including, but not limited to, Malathion, from a point source (helicopter, truck, etc.) into a navigable body of water constitutes a violation of CWA, 33 U.S.C. §1311(a)See Long Island Soundkeepers Fund, Inc. and New York Coastal Fishermans Assoc. v. New York Athletic Club of the City of New York, No 94 Civ 0436,1996 U.S. Dist. LEXIS 3383 (S.D.N.Y) Mar. 22,1996) (copy attached). The City to our knowledge has not obtained a permit for such a discharge from the National Pollution Discharge Elimination System ("NPDES") as required by CWA. Or in the alternative, the City has violated or continues to violate such permits. Or in the alternative, the City is acting under an improperly issued permit; and continues to exceed the effluent limitations contained in the CWA.
Furthermore, the City's haphazard spraying, has created an imminent and substantial endangerment to health and the environment in violation of§7002 of RCRA, 42 U.S.C. §6972(a)(1)(B) and violates the hazardous waste management standards of Subchapter III of RCRA, 42 U.S.C. § 6921 et seq.
The city is also in violation of the Safe Drinking Water Act, comprehensive environmental Response, Compensation and Liability Act.

Environmental and Health Hazard: Why We Are Demanding that the Indiscriminate Spraying of Insecticides be stopped Immediately
1) WHEREAS, The limited handful of recent deaths due, possibly, to encephalitis does not of itself warrant the indiscriminate and repeated spraying of insecticides over the entire population and territory of the City of New York;
2) WHEREAS, Contrary to law, there was no risk assessment issued concerning the effects of massive and indiscriminate spraying of Malathion, Resmethrinand Sumithrin on the population and territory of the City of New York;
3) WHEREAS, Contrary to law, there was no environmental impact study issued pertaining to the effects of the insecticides individually; nor of increased risks to people's health and environment due to cumulative exposures(regardless of concentration levels of a single exposure); nor to the synergistic (combined and multiplied) effects of the different chemicals on living organisms and environment; nor to the effects of the chemicals when they "break down", in the case of Malathion into even more harmful chemicals; nor to the impacts of mass-spraying described by affected individuals in lawsuits in Florida, Texas, California and in other parts of the country; nor to the consequences of mosquitoes developing resistance to insecticides and the possibility of future health crisis as a result of the mass-spraying.
4) WHEREAS, Before the Malathion marathon began in New York City and contrary to law, there were held no public hearings on the risks to the public of the Mayor's "emergency" directives with regard to the repeated spraying of the entire population and territory of the City of New York;
5) WHEREAS, Contrary to the law, "the least harm" non-toxic alternatives and integrated pest management approaches were apparently not even considered, let alone publicly discussed;
6) WHEREAS, the Mayor of the City of New York, and other government bodies,had defunded significant mosquito-control and other related public health programs of previous decades, leading us into the current situation;
7) WHEREAS, the Mayor repeatedly advised residents of New York City that the insecticides were "perfectly safe" and "harmless", in flagrant disregard of extensive medical documentation to the contrary and in violation of the Environmental Protection Agency codes and pesticide law;
8) WHEREAS, the City government established no hotline or agency to record spray-related health complaints from city residents; nor did City hotline and poison control phone numbers that were distributed by the Mayor's office and Department of Health accept affidavits from people affected by the insecticide spray.
9) WHEREAS, Thousands of people who are homeless, or who suffer from asthma, allergies or immune compromised ailments, have reported to independent agencies and the media that their conditions have been severely worsened by the blanket spraying;
10) WHEREAS, There is increasing evidence of the long term health and environmental risks of spraying insecticides such as those deployed in New York City, particularly on children, and on wildlife;
11) WHEREAS, the City has sprayed people and waterways continuously from helicopters and from trucks, and has taken few if any precautions to contain the "drift", contrary to the regulations for applying the insecticides in question;
12) WHEREAS, little or no advanced warning was given to people to "get off the streets" or "get out of the parks" before helicopters and trucks began spraying everything in sight, sometimes in the middle of a weekend afternoon with parks and streets filled with children, adults and pets;
13) WHEREAS, serious questions have arisen as to whether sub-contractors doing the spraying had obtained the required licenses, provided their workers with adequate masks and clothing, and were properly provided with oversight by the responsible government agencies;
14) WHEREAS, the Mayor and the City administration have acted arbitrarily and capriciously, in reckless disregard for the health, safety and well-being of New York City's residents and visitors and the city's waterways;
15) WHEREAS, the Mayor and the City administration are responsible for the unnecessary deaths in large numbers of birds, bees, butterflies, fish and other creatures, and the poisoning of the eco-system;
16) WHEREAS, the City administration and the Mayor's office make it difficult if not impossible to acquire needed information on all of this in a timely manner.
THEREFORE, WE DEMAND:
1) A complete and immediate halt to the spraying of Malathion, Resmethrin,Sumithrin, and other insecticides claimed to address the St. Louis encephalitis and, now, West Nile-Like Fever-carrying mosquitoes.
2) A thorough public hearing with all perspectives welcomed and presented.
3) A Federal Investigation of the reckless, arbitrary and capricious actions of the Mayor of New York City, the Office of Emergency Management,and the Department of Health, the NY State Department of Environmental Conservation, New York City Department of Environmental Protection, in jeopardizing the health and welfare of the populace and environment.
4) An independent assessment of shorterm and longterm effects of the spraying on the population, as well as on the ecosystem and water supply of New York.
5) An end to random blood tests. Since there has been no confirmation of the virus in mosquitoes in New York City, what are they actually testing for? There is mounting concern that this may be a prelude to mandatory testing and vaccinations.
6) Independent toxicological examinations and reports on all birds and people. Right now this obvious procedure is not being done. Thousands of dead birds have been recovered, with only a dozen or so found to have the West Nile-like virus. What about the 3,200 or so dead birds examined in which this virus has not been found? What did they die from? And why aren't government agencies doing such toxicology reports?
7) A reversal of the free distribution of insecticide with DEET. This is extremely dangerous for young children. The amounts distributed are far in excess set as safe for children.
8) Publication of the list of all contracted insecticide companies,manufacturers and spray applicators; all financial details pertaining to the mass-spraying; and, full disclosure of each company's track records with respect to pesticide violations here and elsewhere.
9) That all connections between the City and the OraVax corporation be made public immediately.
10) That the Environment Protection Agency give high priority and take immediate action to protect the public and halt all spraying, and that EPA take an active role.
11) That EPA hasten their efforts in making determination about the dangers of malathion and the other pesticides that were sprayed in New York City,and assess the impact on the environment of the spraying that has already been done.
12) An immediate investigation as to whether Mayor Giuliani's repeated assurances as to the safety of the pesticides being used constitute criminal negligence.
13) Finally, in light of the flagrant disregard for the health and safety of New Yorkers and the environment, we demand the immediate resignation of Mayor Giuliani.

The Malathion sprayed in New York is made by Cheminova, a company from Denmark with branch offices in Wayne, New Jersey. The company has an emergency, toll-free hotline: (800) 228-5635.
In addition, Karl Grossman writes that "The Division of Vector Control of the Suffolk Department of Public Works provided the initial supply of Malathion -- rushed to the city under police escort -- and technical assistance. A helicopter of an East End helicopter company with a contract to do pesticide spraying in Suffolk was first on the scene in the city to do spraying after incidents of mosquito-borne St. Louis encephalitis showed up there."
This is actually the first I've heard of another source for the Malathion.The source is important, for the impurities in the chemical soup, as well as the so-called "inert" ingredients, are often as dangerous as the"active" ingredients themselves. So we need to know where they were mixed,who manufactured them, etc. If anyone has more information, please send it along.

We need all the help we can get to counteract the city officials' egregious assault on New Yorkers. According to the Chemical Warfare Biological Handbook distributed by the city of New York to EMS vehicles and NYP Dpredincts (and bearing the seal of New York as well as the Mayor's name), malathion is "a commonly used organophosphate insecticide that causes the same biological effects as nerve agents." Our committee is working on the task of finding health care professionals and scientists who are concerned about the spraying of malathion and other chemicals indiscriminately and constantly over the city of NY and are willing to give their knowledge (of long-term effects), personal information (of short-term effects such as emergency room statistics) and/or their support to our lawsuit against the city; we are hoping to find some medical experts who are willing to go on record, in writing.
